I have a few questions here.
1. Does it really matter what date the 485 application was filed, if it was filed within the specified time-period ?
I mean, will it matter if someone applied for 485 on July 30th or August 17th, other than trying for an EAD and AP earlier ?
2. Is there a benefit of applying early in the timeframe, in getting an approved 485 ?
Please respond at your convenience.

I came in 2003 on an H4 visa with my parents who were on H1B, I was 17 yrs old at that time. I then got my status changed to an F1 in 2004. I completed my bachelors and have been accepted into a masters program on a scholarship. I wanted to visit India, however I would like to know the risk involved in doing so. Would I still be at risk of not getting a f1 VISA in India even if I carry my approved F1 petition? Please advise..Thanks..

My I140 was filed 10/01/2007 and it got approved Jun 4th,2008 I think the processing dates are little misleading.

Hello all, with the August bulletin showing June 06 cut-off dates, I have the following questions for which I seek input form IV members.
1. Is it possible to apply for the GC, the second time, if one cancels his GC "without prejudice"?
2. If yes, is it possible to use the priority date of the canceled GC in the second GC application?
3. What are the points one should be aware in canceling GC "without prejudice"?

Hi,
I was working for a telecom company. I passed 6 years and then was on 1 year extension. Meanwhile my I140 was approved. Lately i was given pink slip and then transfer my H1 to another company. i couldn't join the company since i was waiting for approval notice for my H1 Transfer. Today i received the denial notice for my H1 transfer and extension. I called to the lawyer and they told me to file for B2 as they haven't received the notice as of yet. So the reason of denial is still unknown. I was wondering what are my current options? Should i wait and file a motion for the H1 transfer denial or should i go ahead with B2? Please advise.

Guys,
My company is forcing everyone to fill I9 form. I have EAD but maintaining H1 status and did not use EAD. I did some research on I9 and it is no where mentioned that only people with EAD has to fill this. I need Guru's opinion on this.
I just don't want to loose my H1 status in any case.
I-9 should be filled by every employee, irrespective of your visa status; Go through the list A, B and C documents, it is self explanatory. This is the proof that you reported to work.

Just want to share my latest info. As you know my case has been stuck in Boston-CIS since May 22, 2007 after interview. Latest SR got me a letter yesterday from local office stating "need to perform additional review...blah...blah..." On other hand I got another letetr last week from CAO-USCIS as Washington signed by a supervisor staing that my case is stuck coz "I never attended NSEER interview in 2003 and as a ocurtesy she has arranged for my interview at ICE office in Boston". I was amused coz my passport is littered with NSEER stamps and I had the same RFE during one of EAD renewal and after the reply they promptly approved the EAD!
It speaks volume about USCIS's efficiency. Anyway, I'm saving all these letters and will file WOM at the beginning of next year.

For an individual, let’s say an I-485 was pending since July 2007 (I-140 approved) with current employer A and she moves to an employer B on a similar job on a H1-B transfer invoking the AC21 portability.
1) After the move, if the I-485 gets denied, can the person still retain the priority date of the underlying approved I-140 in any new application if she files with the same or a new employer.
2) After the move, if the I-485 gets denied and the person loses her job with the employer B, can she take a job with employer C by transferring the remaining time on her H1-B visa.

I have the following questions with respect to number of days I can stay out of the country for my situation.
I have been on green card since June 2010.
I have visited India from October 17' 2010 to Feb 4' 2011 (Total 111 Days).
Now I need to go back to India again for around 3 months (Approx 10th May - 10th Aug) which is about 93 Days.
My questions are:
1. As a GC holder can I make the above visits without resetting my 'Continuity of 5 Yeard of Residence' clock ? As in each calender year I will not be out of country for greater than 180 days. But, when you count from October 16 2010 - October 15 2011, I will be more than 180 days out of the country.
2. If answer to the above question is NO, do I need to file/apply for any exception to be out of country?

My h1-b is expiring in decemeber, i applied for renewal 4 months back but it is stuck in security check. I can apply for 485 as my 140 is approved.
1. if i apply for 485, then EAD can also go thur sec check?
2. after 240 days if EAD is not available what are my options?
3. I am planing to get married but cant bring wife on h4 as my h1 is not current, what are my options? if my 485 get approved or i use my EAD i wouldnt be able to bring her?

Okay anyways, here is my entry. I drew this from a picture that was taken of me (left obviously) and my cousin in Disney World last June.
I'll scan it once I get my printer/scanner/cappuccino-maker all set up (just moved into a new place). I'll also scan the original photo so you can compare.
Anyways, I thought it turned out well, although I kind of look like a zombie and all my fingers look sort of broken. :lol:
