Iam sure lot of people have asked this question.
Iam in my 6th yr of H1b.
I have my I140 approved and I received my 3 yrs extension.
Question is can i shift jobs now? What are my options?
Once I move to the new job and file for GC, can I claim the old PD date ?

Hi,
I am currently on H3 visa. My 2-yr term is coming to an end. My company had initially told me that they would find me a job internally and then relocate me to another location outside of the US after my training ends.
However, the company has not been able to find me anything in other regions, which essentially means I will be laid off. I want to know if the company is liable to pay me severance / air tickets back to my home country??
My employer is currently saying that they are not responsible for my airfare. That provision is only for H1B's. However, if the intent of H3 visa was to bring me for training and transfer me so that I could use that knowledge somewhere else. Even in the H-3 filing papers my company stated that their intent was to provide me employment in other regions after the end of the training. I don't understand how can they leave me stranded. They should be liable for something (severance, airfare)??
Please reply if you have any advice.

I see that India got around 27400 Gcs. Does it mean spill over was happening during FY 2007? I was under the impression it started since FY 2008.

I have applied for AP (I131) on 8/14/09 and my I-485 got approved on 9/01/09. Is USCIS is going to return my I131 fee or is there anything I have to initiate from my end to get the refund?.

You cannot use the “AUTO VISA Revalidation” rule once you go for stamping.
Please share your experience of H1b visa stamping in Halifax or Quebec (Canada).
I am planning drive to Halifax or Quebec end of this month.

If I understand it right.. The whole House of Reps is up for re-elections every 2 years and 1/3 senate members get reelected at the same interval too...
Does any one know what happens to pending bills at the time of elections..Specifically regarding S2611...If say the conference committee reaches a compromise just before elections but for some reason they dont get to take a vote on it... Does the new senate and house carry the bill forward from that point or does the bill gets reset ?

I am on h1-b since Oct 1, 2004. I am EB3-ROW (Rest of World). My company has filed I-140 in June 2006 and it has not been approved yet. How soon would I be able to change jobs? I'm about to finish my master's degree and am hoping to get a job that falls in either eb-2 or eb3 category. How will this impact the ability to keep my i-140. Would i have to start from scratch with my new employer if i find a new job?
Also what is considered my priority date since I havent/cant file an i-485 yet.

One of my friends has goofed up his labor filing:
His actual date of termination with his previous company was 5/31/2007, but in the labor filing he has said that he was employed with the previous company till 6/30/2007....
he is ready for filing his 140(EB2)? can he correct his dates of when he files for 140....
WILL HE HAVE TO file for labor again??????????:(

Do you need to submit copies of your approved LC or I-140 to support your stay beyond 6 years? I don't see it mentioned in the I-129 application.
And do you say yes or no to the following question (Q.5, Part C of H-1B Data Collection and Filing Fee Exemption Supplement form)?
"Has the beneficiary of this petition been previously granted status as an H1-B nonimmigrant in the past 6 years and not left the United States for more than one year after attaining such status?"
This probably wishes to know whether you have a reason to stay here for more than 6 years. But I don't see anywhere to explain that. Any help is greatly appreciated.

I got my labor approved in Jan (EB2 - RIR) , I say EB2 because because all the documentation was done supporting EB2 (BS + 5 years). My job requires that and I meet the criteria.
However, when Applying my I140 , the lawyer screwed up and filed under EB3 and got approved.
I very much want to go for EB2. Is it possible to file I140 again under EB2 with the same LC? If I want to re-file, do I have to or do they (USICS) cancel my previous I140 approval ?
Is filing another LC under PERM and I140 safer route than using the current LC ?
What is the best course of action ?
I know there is a clear advantage today in being in EB2 over EB3 (PD wise) and it looks like most people are converting from EB3 to EB2. I am not sure whether there will be any advantage of being in EB2 over EB3 by the time my PD (oct 04) becomes current.
Any input is appreciated. Thanks in advance guys.

No other fees. If you go to VFS site, everything is written there clearly.
