I am applying to renew my EAD and looking at the paper Application on page 7 I see that if you are C9 which all of us are mostly..we need not file an application fee..
Is it true..

If you paid the new fees when you filed last year then you don't have to pay the fees again this time. But if you paid $180 for ead then pay again now.

As long as you are in status it is fine, what you need is a valid I-94 or a receipt showing that you applied for a timely extension. You only submit documents that are asked by the officer.

Hello,
I recently received my Greencard. Will be getting married in a few months and wanted to find out the options available to sponsor my fiance. Fiance is a british citizen, does that help in any way? Also she is a qualified Doctor in the UK and is planning on taking USMLE part 1 & 2 prior to the wedding. Is it prudent to have her move to the US on an H1B instead?

I initially voted in favour of this, but on further reflection, I think this is bad policy and urge others to not support this.
Giving I-485 benefits to people without current PDs is a bad idea. It creates a class of immigrants who are neither non-immigrant visa holders (h1b) nor are they lawful permanent residents (i-551) with a set of rights that falls into neither category. The AoS pending status is intended as a short-duration temporary "gap" coverage for people who are a matter of months from having actual I-551 rights.
Essentially, this proposal aims to make every month into the July 2007 fiasco. In addition, and this is the truly horrible part of it, relieves US employers of the pressure and costs they feel now, extending H1Bs every 3 years. That means that the only allies that legal EB immigrants have (US Employers who require their services) are detached from the immigrants themselves...they no longer have a dog in the hunt, and will stop whatever pressure they are bringing to bear now upon Congresscritters and Senators to increase the number of EB visas available.
Disconnecting the interests of foreign-national employees from their US employers will weaken the political position of the foreign-national employees. We cannot vote or contribute to campaigns, our employers however, can do both. If employees are shifted to EADs and APs, with no further involvement of employers in their immigration status needed, then those employers become disconnected from the process, and the one and only ally the legal immigrant has is no longer interested. That's a horrible thing for the immigrant to advocate.
I strongly urge IV to back away from this proposal, as it is not in the long-term interests of the EB Immigrant community. I urge IV to instead focus their resources on items that will help immigrants long term, like increasing the number of EB visas available through initiatives like eliminating the DV program and allocating the visas to EB applicants.

Imagine the wait times for the people who haven't yet been able to file for their Adjustment of Status. Wouldn't it help them (and their dependents) if they are at least allowed to file for their AOS? I invite the members to provide their perspectives on the issues raised by JeffDG above. Please do not attack each other. Let us fight together in lieu of fighting each other..

Mercury News ran an article today about H1-B Visas and mentioned that "Rep. John Shadegg, a Republican from Arizona, [was] planning to introduce a bill this week or next that would nearly double the number of H-1B visas".
Does anyone know anything about it and does it include EB provisions, as well?

Hi All,
I went for visa interview in December, but my case was stuck because of administrative processing. I came back on Advance parole. I have the following questions.
1. Can I sponsor my parents visitor visa without any issue? Will the consulate quiz them/stop them because of my H-1 admin processing
2. Also is my admin processing still going on? and can I stamp my H-1 visa in the future after my case is cleared from admin processing.

My LD 01/31/2003 I485 date 10/20/03 extending my EAD 4th time. Stuck in backlog center TX. Any one recently got from TX backlog?

Hi All,
I was with company A until March 23rd 2008 and changed to company B (they filed my H1B transfer as well as extension on 03/24/2008 with vermont center). USCIS didnt process my case until mid of september 2008 and my employer B raised a service request. After 15 days of service request i got a query on my H1B i.e on 09/30/2008. Query was replied on 10/30/2008 but haven't received any response until now and aslo the status hasn't been changed in the website.
On the other side my I-94 expired on August 18th 2008. Its been exactly 120 days until now that my i-94 got expired and came to know from others that i can stay in US for 240 days maximum after my I-94 expiration.
Could you please help me out what are the options i have here with respect to the H1B and also regarding the I-94. Your help is highly appreciated. Plzzzzzzzzzzz help me out.

1. Can I attend the interview in Canada/Hyderabad consulate instead of Chennai. Company attorney said that should be ok and filing I824 for change of consulate would take long.
In case you wanted to know more details about my case:
-Possess I797 from Employer A until Nov13, 2009.
-Filed for H1b extension with Employer B in Feb, denied in Jun15. payroll with Emp B Feb onwards.
-Re-filed for extn with Emp B in Aug4 finally approved on Oct19 but denied extn of stay.
