The following is in the e-mail I got from USCIS in response to my service request placed on 5/27/2008. Does this mean my case has been given to an Officer to look at?

Hi,
I applied for SSN for my wife using the EAD,the person at the SSN office noticed that the date of birth on the EAD was not correct, but still took the application.Our lawyer reapplied for a new EAD last week but we recieved the SSN, please let me know if my wife can work using the SSN or wait till the reapplied EAD is approved.

I had an H1 for about 3 years (2 different employers), and then was hired by an international organization. I gave up the H1 and got a G4 visa, which I still have. Over the last 3 years with a G4, my credentials have changed, and am due to get my masters degree in May 2008. If I were to move to a job requiring H1 when I get my masters, will the total number of years allowed for me to hold an H1 roll back to 6 years? I'm thinking that since the skills I had as an H1B visa holder before have changed now.

Also I would like to see a comprehensive idea posted from IV and drive our members to upvote the idea so it will be on the top as top rated , most commented idea.
Whether DHS will follow through or not at the least we will be educating more people on our legal immigration woes.

Hello,
I joined and contributed already to the IV although I am not yet on the GC queue. I support you all with my heart.
I have a different concern about PERM filing. My application will be EB2 with Ms + 4 years as Senior Soft Eng, and my lawyer asked my manager to create the business necessity letter for MS degree. He is not experienced with this kind of paperwork and the lawyer seems to be just not helpful rather demanding... I was wondering if somebody in IV had to deal with this business necessity letter. Any information would be helpful...

Guys,
Please help me...I do not have much knowledge about GC process. I am working on H1B visa from last 3 years with my current employer and they are ready to apply for GC but, I know that for GC in the same position I cannot use the experience gained during past 3 years. But if I apply for GC for the next level (as GC is for future employment) with the current experience and keep working in my current role until my GC is approved, do you guys see any problem with that? GC approval will easily take 4-5 years and during this time I can keep working in my current position and once GC is approved I can switch to the next level which is kind of promotion.

I believe some lawyers still do 245(i). The fee is $1k. Talk to an immigration lawyer or google "245 (i)"

Hi,
Currently I am on H1B visa.I will file my 485 as secondary applicant.What are my options in case If I have to leave my job and my 485 is still not approved.
Do I need to file H4 (Since 485 is still not approved) ?

You can status will be Adjustment of Status ( AOS ) but cant work . IYou need a APO if you want to travel . If you want to work you need an EAD .

Hi,
I am on H1B and still 4+ years are left on my new H1. I have got my I-140 EB2 cleared in July 07 and applied for I-485 in Aug. Got EAD in Oct.
My question is what is the better option out of the following to change employer:
1. To transfer H1B to new company with the same Job Title as was in previous H1B. I have good relation with my existing employer.
2. Or I can invoke AC21 and start working on EAD with new employer (after 180 days).
Questions:
Q1: If I want, can I come back to my existing employer on same old H1B (if thats still valid) ?
Q2: I frequently go to India (at-least one time in a year). So with EAD and AP, there might be more waiting/ filing each year etc.
Q3: Which is the better option for me - H1B or EAD ?

Now hiring of foreign workers won�t be an easy job for the employers. The government is on its way to make foreign worker rules tougher from this very week.
