    Now a days VFS is not releasing appointment dates more than 2 - 2.5 weeks in advance. I am not aware of any specific time of the day when these become available.

    Hi I just graduated last year as an accounting major. I recently got an offer for a Property Accountant position at a real estate company. So it's not a pulic accounting firm. I was wondering if I'm eligiable to apply for H1B without a CPA?

    NO, a 3-year extension is possible after I-140 is approved. In your case you will get a one-year extension based on PERM which is pending for 1 year, or is approved by the time you need to file for H-1B extension.

    Two weeks ago, I went to Infopass appointment and Immigration officer said they scheduled my fingerprinting next week and will get the notice in mail. This fingerprinting was due long time so they scheduled one now.

    IO asked me whether the date and time is ok for me and I said yes i.e. next friday.

    But so far I havent received any notice regarding this.

    What to do now? any one had this problem, please share your experience....

    Seems there are so many issues for us to face on the journey to live the American Dream. I wonder how many members have been affected

    Death of a petitioner, Step children of USC and H1B children aging out, E 2 children having no status upon reaching 21 years. And the lack of a retirement visa for our parents (usually elderly) to move to the USA, retrogression amongst other issues like delays errors

    Guys ,
    Here is my situation. greatly aprecite if you could give some suggestions.

    I am presently on Non-cap H1b(which is not counted under cap). I am planning to file for H1b thru an employer in april under MS quota with a start date of octber 2008.
    My concerns are...

    1. How should the new employer file H1b so that I can join at my wish after oct 2008...??

    2. My present H1b is valid untill 2010. SHould I be in US while filing and untill my new H1b is approved..??? I ahve plans of visisitng india in March/aprial. So wondering If i need to visit and be back before april or is it ok to travel while my new H1b is filed using the presnet i-94..?? that is trvelling sometime In april/May..???

    My wife is currently on a B1/B2 status which is valid for 10 years. She has an appointment to get her H4 stamped next week. Can she have both the B1/B2 and H4 visa stamps at the same time or will they "Cancel without prejudice" the B1/B2 after the H4 is stamped?

    Is there a way to request the consulate not to cancel the B1/B2 visa?

    Hi:

    After at least 3 - 4 calls, over the last month, I finally spoke to IO at NSC. And she took my LIN numbers(other IOs did not even bothered). And then after 1 minute she replied that..my case is waiting to be assigned to Officer.

    I even got my I140 checked but she was patient and told my HR that whole cas e is waitng to be assigned to Officer.

    Is this something to be looking forward to or is it a usual reply?

    Did anyone get this kind of reply?

    I am currently in my 6th year of H1-B. I started working for my current company on H1-b work visa in June 2010. As my 6 year visa period expires in June 2011, I need to apply for a H1-b extension (based on I-140 approval) pretty soon. My employer had paid the $1500 ACWIA fee recently i.e. 8 months ago, when they filed for my H1-b the first time. Next month, when they apply for an extension of my H1, do they have to pay the $1500 ACWIA fee again?

    In I-129 instructions, it specifies that one of the exemptions for paying the ACWIA fee is "second or subsequent extension...". Would my case be considered a subsequent or second extension?

    I would greatly appreciate your response.

    My current H1 expires on Sept 30. My employer is planning to apply for an extension in the first week of April. Can they file my LCA in advance so that they can have an approved LCA by the first week of April? Or, do they have to wait till Apr 1st (6 months before current H1 expiration) to file for the LCA ? I was not able to find information about this specific scenario.

    Hi all,

    My I-140 was approved 2.5 years back and I-485 was also approved more than an year back.

    But, today the status on my I-140 got changed to "REQUEST FOR INITIAL EVIDENCE SENT, CASE PLACED ON HOLD". I am not sure, why did they reopen the case again. I checked with my company and they assured me that they didn't revoke my I-140.

    Could anyone suggest me what's happening to my case. Has anyone seen an similar kind of an issue and wat shd I do further ?

    Gurus, I am on H-1B visa doing a project with 'abc' client who is the client of 'X' company and pays to my H-1B employer 'Y', I get paid from 'Y'. I started on this project on H-1B visa but now I have EAD(spouse of primary applicant) and want to change my status to EAD. The X company says that they have non compete agreement with Y company(my employer) and can't bring me on board unless I get email from my employer stating they have no objection me moving to EAD. My employer is not ready to give me that email(for obvious reasons.. after all it is a desi employer).
    I want to find out if there is a way out..also I never signed any agreement with my employer..in fact I don't even have a copy of offer letter. The only agreement I have is with X company that I can't go back to the same client for one year, the day I end this project. I am based in Boston MA.
