Hi All,

My wife is on H1 since Oct 2009. No paystubs. Now she want to come back on H4. Her H4 stamping expired. I have my H1 renewed in Oct 2009 and need stamping.

What are the best and low risk options to convert to H4 status. Please advice

When did her latest I-94 expire?

She most likely is out-of-status for a long time (more than 6 months). Also she started/would start accruing illegal/unlawful presence from the day her I-94 expired/expires. Talk to a lawyer before doing anything.

Thanks. The A#, DOB and photo are correct on the card. Can I use the EAD card and at the same time file for a correction.

Hi All,

We are having same problem, received I-539 copy and it is showing class type H1b for my wife, and it is supposed to be H4.

Can anyone let me know what is the procedure for correcting class type??

The article says that dates have moved forward because the people whose dates are current, have not applied for their visas

And suppose we could do the same -- if no one applies the gc even once the PD is current, there will be forward movement.... then WHAM! In one go, all could apply

I am in L2 visa right now and I have an EAD to work. I got a job that I need to start on oct 01.

My spouse status will change from L1 to H1B from oct 01, as his employer filled for H1B.

Our L1 & L2 are valid until Aug 2011.

I don't have H4 yet.

What are the various options available for me to work?

1. Can I use my EAD to work which is valid until aug 2011?

2. Can I apply for H1B for me? If yes when I can start working with my H1B.

3. Is there is any way to maintain my husband L1 status until it's validity(Aug 2011) and then switching to H1B after L1 expires?

I have two I - 140s pending (say A and B)

I am applying I-485 for A (140)

If my I-140 for A gets denied can I change the I-485 to use I 140 from B later?

Or do I need to apply for I-485 freshly with I-140 from B?

I am on H1B 8th year extension, my priority date is September,2004. When I join new employer, Will I lose my current priority date as well as LC?

Depends on whether or not your I-140 is approved. If it is, and your old employer does not withdraw the petition then there is a possibility of carrying on with your old PD. I am no expert on this, but the issue has been discussed several times on this forum. Do a search for more info.

I applied under the EB1 B at the NSC in January 2010. A month later received an RFE challenging all 6 criteria. The RFE acknowledged some of my work. I sent in more evidence in April. After 2 months of no reply - I opened a SR. Then a month later, I received an RFE again. It was the same RFE with only the date changed. There was no acknowledgemnt of the additional paperwork sent in response to the first RFE.

Any thoughts on how I should proceed.

Hi,

I have applied for H1B extension for 3 years based on my I 140 approval. I have submitted all relevant documentation except for client letter.

My current H1 expires in Oct and we are expecting our baby in October as well. I would like to know what would be my options in case my H1 extension in denied. I cannot leave with the new born atleast untill december (need time to get passport n visa for the baby) and I wouldn't want to get into any legal issues like staying in US n not being in status.

Looking forward to your advice and suggestions
