My future employer "A" has filed an appeal I290B for denied I140 ("Inability to pay") which is pending at USCIS, however now my current employer "B" wants to file I140 for me. Both of this are on different labor approvals and different job descriptions. Can my current employer "B" file I140 without my future employer "A" withdrawing the I290B appeal? Will filing of I140 by my current employer "B" affect the denial of any of these applications?

As per the new information USCIS is planning to finish receipt update by end of the month. My application was filed on July 19th and received by B Fisher at NSC. All the folks who applied with me got their checks cashed last week.
My I140 was approved from NSC last year.
How many people are in the same boat. I know from other threads there are still people waiting from July 2nd.

I just received the I-140 Receipt Notice and noticed that the section I am filed is not correct Sec.203(b)(1)(c) i.e multi-national Executive or Manger
where as I should have been filed for sec.203(b)(3)(A)(i) or (ii) Skilled Worker or Professionsal
I am going through Substitution process and the Previous I-140 was approved for sec.203(b)(3)(A)(i) or (ii) Skilled Worker or Professional
Now my question is what is the procedure to rectify this ? Also will I hold on to the processing dates {NOT Priority date} (say May 25th) for I-140 or should the lawyer file new appliaction which will push my I-140 petition dates to June?

I joined and contributed already to the IV although I am not yet on the GC queue. I support you all with my heart.
I have a different concern about PERM filing. My application will be EB2 with Ms + 4 years as Senior Soft Eng, and my lawyer asked my manager to create the business necessity letter for MS degree. He is not experienced with this kind of paperwork and the lawyer seems to be just not helpful rather demanding... I was wondering if somebody in IV had to deal with this business necessity letter. Any information would be helpful...

I was wondering if this recession could turn out to be a silver lining for those of EB2-I,C who manage to survive it. Come to think of it, with all these job losses theres bound to be a downturn in hiring - resulting in lesser number of EB1 and EB2 ROW applications. This means more could overflow to EB2 I and eventually EB3 (I,C and ROW) survivors will benefit to.
Although we also need to remember that the H1B quota will still get filled up on Apr 1 - recession or not. So don't really know how this would turn out.
What are your opinions folks?

Looking for advice on my case -
We (I and my wife) filed for 485/EAD/AP on July 27 2007. We received all documents (receipt#, AP, FP etc) except EAD for my wife. The case status online shows her EAD application was received and pending. So on Jan 24th we put a Service Request for her EAD application. Yesterday we received a letter from USCIS with the following information --
The status ofthis service request is:
WAC-XX-XXX-XXXXX
Your 1-765 application was administratively closed on 0112912008.
If you have any further questions, please call the National Customer Service Center at 1-800-375-5283.
If anyone has similar experience or know why they would close a case without giving any information or RFE/NOID etc? I tried calling them but the IO couldn't provide any further info.

As per the latest regulations, the employer has to pay for all the labor application cost. My employer has agreed to do my green card, but are little hesitant to pay the cost (due to budget constraint). What legal options/adjustments can I make with my employer so that the cost process is not delayed? Can they deduct part of my salary to bear the cost etc...?

Thats illegal. You don't want to get into trouble in future so please do not do that.

After at least 3 - 4 calls, over the last month, I finally spoke to IO at NSC. And she took my LIN numbers(other IOs did not even bothered). And then after 1 minute she replied that..my case is waiting to be assigned to Officer.
I even got my I140 checked but she was patient and told my HR that whole cas e is waitng to be assigned to Officer.
Is this something to be looking forward to or is it a usual reply?
Did anyone get this kind of reply?

Hello,
If you have a valid dual purpose visa like H-1B, then you don't need AP to reenter US, but if your visa has expired, then you must hold AP to reenter the US. EAD is work authorization (which allows you to pursue employment without restrictions inside US), but it is not a travel authorization.

Can we apply for a new EAD/AP after they expire?
If so, what is the difference b/w applying for an extension vs. a new one in terms of fees/documents/photos/etc.?
The reason being I already spent $1000 for EAD/AP last yr. but never used it, and now I have bear all H1 (extension) expenses as well as employer sucked all my blood & is after my limbs after 8 years of slavery. On top of that has stopped paying salary since April.
Hence I am trying to cut corners whenever wherever possible. Any responses or help greatly appreciated.
