I have filed a 485 since i married a citizen. I have had my interview with the immigration officer, since my application is 2 years old (do to the excesive moving ive done) she asks me for another medical and a co-sponsor. Medical is no problem, but i cannot produce a co-sponsor. i need a co-sponsor because my wife has 5 kids from a previous marriage, and the household income does not meet that of the guidelines. We do not have any relatives or friends that can help. I have to submit this information by Jan 21 2009.
What are my alternatives?

hi,
I am planning to extend the visitor visa for my mom for another two months.
Her current I94 expires on June 25th and At POE the officer told her that she must go back after 6 months
If I apply for extension of her visa before 45 days and she leaves US on current I94 date (June 25th) since she did not get a result,
1.Does she need to apply for a new visa since her extension got rejected even though she left before her current I94 date?Will it affect her future visits in case that extension gets rejected.?
2.What happens if she gets a rejection before her current I94 expiry on July 25th, will she need leave earlier and apply for new visitor visa?
Appreciate your answers

Hello
I am in AOS with priority date of EB2 Dec 2006. We are moving out of USA due to spouse getting a job outside of USA. If we want to retain our priority date and green card, what are we supposed to do before and after we leave USA?
In case we want to make temporary visits to the USA, do we have to apply for visitor visa? I am assuming that we will not have AP since we are not inside USA. Will we even get a visitor/business visa since we have an immigrant visa which is pending with USCIS?

Maybe the 60 Minutes story from a few months ago is making a difference. DHS finally agreed today to show some humanity and not proceed for two year with deporting widows and widowers of US citizens (often American soldiers who die in combat) who only were denied green cards because their spouses died before USCIS could finish processing their cases. The courts have not been consistent in their rulings and it is going to take the US Supreme Court settling the matter (or DHS backing down). Hopefully, this marks the end of USCIS' rabid pursuit of a population that deserves...

I have a quick question. Should I go ahead and apply for my wife's I131 – Advanced payroll too with her 485/EAD. The way I understand 485/EAD/AP is as soon as she gets her EAD, she would want to work and in that case it would be recommended to have a AP too. People suggest that AP should/can be applied later on but I do not see any benefit in saving 6 months/170$.
Also let me add that my wife will be in US from August 10th to August 26th and then November 10th. As you have to be in country till AP approval should i defer applying her AP now. She is currently on H4.
Please suggest.

I'm looking to travel to Puerto Rico for a few days in July for my honeymoon but both my green card and passport have both expired. I have been in the US since 1988 and don't travel aboard very often so I overlooked this issue.
I have been told that I can travel to Puerto Rico with just a valid driver's license but don't want to take a chance of having them ask me for my passport and green card and then not being allowed back in the country. I would think that if they ask me if I'm a resident alien, they woudl want to see a non expired green card. I assume it is too late to go through the renewal process for both with just a few weeks left before my trip. I would love to know if I need to go through the renewal process for my passport, green card or both in order to fly to Puerto Rico or if I should just stick to US states.

Previously , I was working in Kuwait. My H1B got stamped in Kuwait.
I didn't face any problem in the visa interview.
However, I don't know much about UAE.

My PD is Dec-04 and I-485 filing date is Sept-07.
I changed my job in Aug-2008 and discontinued my H1B which is expired in Sept-2008. Now my only legal status is 'adjustment of status from H1B to Permanent Resident'. I think this is very common state most of the people waiting looong for GC fall into.
Now, I saw one of my friend's i-485 denied (with NO option to reopen!) bcoz an approved I-140 was not attached to this application. I agree that this is not simple mistake for USCIS can ignore, but there is always a 'very very remote' possibility that every application can be quetioned due to some flows in the filing.
Here is my question: Since I discontinued my H1B status and I am still in this country, can I apply for a fresh H1B? I am thinking because H1B quota is still open this year and to face any unexpected reason for 485 denial!
