For the past few months, there have been no green cards available for persons in the employment-based third preference category (EB-3) and long backlogs in the EB-2 category for persons born in India and China. So, with few green cards to grant, why has the USCIS been scheduling interviews for persons in these categories? The short answer is that just because the USCIS cannot grant most EB-3 and EB-2 applicants green cards, the agency can take advantage of the lull in applications for adjustment of status to deny persons with pending applications. it asks last five year employment history , i have not worked in USA for the past 3 year but i have worked abroad before these 3 years.. should i write it in the column or i should write NONE as i have not worked here in USA .... i am not the primary applicant ... my husband is primary applicant

I am planning to joing new empoyer on EAD even though I have proper H1B. Because employer do not want to sponser for anything. My wife is planning to go to india during this period and she will be using H4 for travel. My questions are
1. Can I swith to new job even though my wife is not here and she is going to use H4 visa which she got it as aresult of my h1b visa from my privious employer.
2. What are the thing we need to do or check before joining the new employer.
Any help in this regard is highly appriciated.

You cannot apply for I-485 unless I-140 is approved as EB1 is purely based on I-140 not labor.

Only during I 140 USCIS will ask for Exp letter whatever you showed in PERM. I think your previous exp should be related to your new job role.

Hello Gurus:
I am self filing my EAD/AP: Following documents I have attached to both EAD and AP.
1. Copy of previous EAD/AP (both front and back)
2. Copy of 485 receipt notice
3. Copy of DL/ passport, Visa stamp
4. Copy of I-94 front and back
5. Letter stating why AP is required
6. Letter requesting fee exemption due to filing under new fee structure.
Can I send all applications in one packet? Or should I send them in separate packets?

When to expect EAD /AP if I had filed my EAD/485/ on June 10

I know it takes 3 months but with this kinda mass filing I want to know the date to make some decisions

I assume that your girlfriend is a US citizen. See here for the permanent residence (PR) procedure: Family-based Marriage Immigration categories - Elaine Martin Attorney (http://martinvisalaw.com/family_lpr.html). Getting married or starting the PR process should not affect your company's L-1 extension petition.

It means Advance Parole. You will be eligible to apply for AP if your application for adjustment of status is pending with USCIS, and you need this document to re enter the US from overseas travel.

i-140 applied in Jan 2006, RFE received question was for company not self, i-140 withdrawn.
Reapplied for i140 in June 2006 under new company, RFE recived 1 week back.
i485,AP and AOS package reached USCIS per DHL August 6th.

I think once you use EAD; you will no longer in H status.

Mine was filed in august 2007. It took 45 days for it to get audited and it has ever since been in process, that is close to 7 months after audit response.
