Much as I'd like to participate in this campaign, it's the employer's signature that I can't guarantee. My employer is a big and prestigious (supposedly) company and will not want to sign this petition or do anything against the counsel of the attorney. The attorney is not gaining anything by expedited processing of the I-140 and won't support this either. He's an AILA member too, if that's of any significance.
If this is worthless without the employer's signature, then I'm unable to participate in this campaign, though it is a worthy effort.I would urge all members who can get the employer's consent to definitely participate and wake up the USCIS from it's slumber.They need a big kick up their you-know-where, especially the TSC.

The movement EB-2 china gets some times is solely because of the visa number that category gets. This typically happens in the first Q. EB2-I and EB2-C will have different PD's . Some time in 2nd Q or mid 2nd Q, both I and C will have used up their quota and they will continue to have the same PD until the end of the fiscal year as PD is the only thing that matters.
the point was that they if their dates also move to june 2006, then it would be the first time they crossed the jan 2006 threshold.

No, this is only the processing time for labor application, the whole process took a lot longer than this. I first submitted my document to the lawyer in the last week of January this year. Lawyer prepared my case, wages approval etc. it took around 1+ month to get preventing wages. then advertisement, recruitment process etc.
almost 8 month to finish all the requirements before the company could actually file the labor application.

No LUDs. I had not checked my case status in the last 4 months and then I just received this email.

My application was sent on June, 14th and delivered on June 15th (I have the FedEx tracking info and signature page confirming 6/15).
The case status online based on receipt number (obtained by calling them a few times until I got lucky) says:
"On July 11, 2007, we received this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS, and mailed you a notice describing how we will process your case."
Not sure if the online status is referring to the receipt date or the notice date when it says "On July 11, 2007, we received" when, in fact, they received it on June 15th!!

You will be able to see your actual RD in the reciept notice...Donot worry..

What can we do, so that USCIS does not really issue that many FS category visas during 2007 - 2008?
It is so confusing that I do not know how to explain the whole thing.
Here is a small sample.
In 2002 all the EB visas were issued(174,968). However, there were 31,532 unused family preference visas, so the limit for 2003 was 171,532 (140,000 + 31,532).
Guess what, in 2003 they only approved 82,137 EB visas, so they ended up with 88,482 unused EB visas

Plus, think about it this way, without this current, you won't be able to file your 485 anyway till next year.
Relax Buddy , now that the bus has come they will keep coming .Most of the people will go in this bus. The dates will retrogress for some time and will be current maybe next year . If not this bus then the next bus . No use raising your blood pressure for this . Attorneys and the media have a habit of scaring people unnecessarily . My point - I am going to take things in a stride, basically wait till I can - doesn't hurt me as long as I go about my daily routine.
All who are thinking of jumping the fence and giving up, one piece of advice - if you do not have kids and plan to have any in this life, please do it NOW - have them be born here (all of them) and then move on with whatever / wherever you want to go.
At least this is a gift you will be giving your kids for their lifetime and all the generations following them (remember - a US citizen's kid can be a US citizen no matter where he/she is born) - so you will be arranging US citizenship for all your great^n * grand * kids (0 <= n <= infinity) !
This is how I think about it when I do not think about MYSELF. Once the kids are born, you can flaunt their American Passports and feel happy in their well-being and security (for whatever it is worth) and move on to Canada / India / Singapore / wherever! Live happily.
And do not forget your kids can sponsor you when they are 21.

USCIS is very clever about the fee waiver. One of my friends got the same kind of denial as I got (trust me we compared the notes) on the same day from NSC. When he filed for the MTR, USCIS reopened his case but with an RFE on his case. He had to send some medical reports, birth certificates and some other documents. In that way USCIS is getting away with wrongful denied cases without refunding any fee back. I have donated $2500 to USCIS for my two MTRs (forget about emotional drain which is incomprehensible and unrefundable). I do not think USCIS will ever give me that money back after it finds there is error in my case. it will definitely come up with some kind of RFE. It is very easy for them......
For that only I am telling we need to teach a lesson. Take them once to court, and if we can get the judement once in our favour it will nail the coffin. If we lose, some one else try again in different court.

Yes story is thesame. The US is unfair to high skilled immigrants. I lived in the US for 8 years. School, worked, volunteered, purchased a home, etc. When the down turn came, I was left high and dry. No unemployment benefits with all the taxes and social security that I have paid. To make matters worse, I was required to depart the same day. I had properties... been living here for 8 years!!
Even though I made this choice, it does not make it humane to have such a system. You ask, what does the US really gain by making people go through the stress, anxiety, sleepless nights? Nothing.

I still have a hope that anything can happen . Being pessimistic never helped anyone. Look what happened at the end of the 80's when all the illegals were given GC and how visa recapture happened in 2000. You never know what the future holds.

My I140 is pending since 16 May 2007. My employer is not helping much. Employer is not giving his attorney contact number also. After calling millions of times they putted one service request 4 months back but nothing happend. I talked to few attonrnies they told they can only work if your employer signs G28 form for me. But my employer is not even picking my phone. Can I do any thing without my Employer's help?
