The Federal Reserve Bank of San Francisco has released a report showing immigration helps boost overall wages for US workers and improves worker productivity. Below are the 2 listed jobs.. I am currently working as ABC for XXX comp... I have been working for more than 3 years.. They are planning to file my GC soon..
I know for a fact that you cannot count current employer exp for GC. If i start working for the same employer on XYZ is it more than 50% different in role so i can count my 3 years experience when applying my GC ??

Kudos to my colleague Elissa Taub who pointed out something rather interesting that none of the supporters of the Arizona law have told Arizonans. Under federal immigration law, a removal proceeding is a civil proceeding and one is not entitled to a public defender or any assistance in paying for help from an immigration lawyer. However, the new Arizona law makes it a state crime to be illegally present in the state. What this means is that any person charged under the new law is entitled to a taxpayer funded public defender or taxpayer funded private lawyer. And we lawyers...

my company have applied for H1-B & H4 extension for myself and my wife. My wife now is looking to go for work and has got an offer from a company. The company will be doing a premium processing of my wife's H1-B and it is expected to be approved in 2 weeks. my wife has already held H1 status before, so she doesn't fall undr the cap. If my wife's H4 comes thru later, what status will she hold?

Hi, I'm sorry to inform you but the mutliyear EAD cards are not here yet, so your EAD will be for only one year. But congratulations on getting that!:D

Thats correct. Once the I-140 is denied all the status' that comes with it goes away. So EAD, AP etc are no longer valid. Keep on extending H-1B and if the I-140 ever gets denied then you guys can move to H status.

I have worked for Company "A"(Ex-employer) under H1-B(company A holding my H1-b) from 2007-2010. During 2009 & 2010, company A was unable to clear all my payments as the company went through some financial hurdles but they issued W-2 for the amount paid in fiscal year 2009. Now, company A has got money and they decided to clear my back wages for 2009-2010 through 1099 form. I transferred my H1-B visa to Company B(2010) then to Company C(current employer). Now, Company C has started my Green card(GC) process.
Questions:
1. I already received W2 for 2009. Can company A amend the W2 for the back wages?
2. Is it legal to take the unpaid amount under 1099? Will it affect my GC process?
3. What are my options to get my back wages from company A?
4. Company A want to issue 1099 along with a letter stating that i was full time employee for the time period mentioned in 1099. Is it acceptable?
I really appreciate your help for taking your valuable time in clarifying my questions. I look forward for your reply.

We like to share that the H1B cap is extremely close to being reached. The count as of December 15, 2009 is 64,200. This is 1300 cases more than the count from December 11th. This count is very close to the total cap of 65,000 which is actually somewhat reduced by numbers allocated under trade agreements. We continue to watch this very closely, and will provide updates until the FY 2010 cap is reached.
We suggest to act quickly to avoid last minute embarrassment as H-1B Cap may soon be cease to exist.

Antis point to polls showing more Americans support the Arizona bill than oppose it. But other polls - including new ones from ImmigrationWorks USA and Immigration Voice, show these same voters also support - by wide margins - comprehensive immigration reform proposals that contain legalization programs. Hi,
Since iam nursing my son,mmr vaccination was not given to me.i saw my report and compared.In the contraindication colomn ,he checked for MMR vaccination.This means for some reasons(or if under medication) i was not given this vaccination?Did anyone experience this?will i b asked to take it ?

Friends,
I came to USA on H1B on Feb-07. I was working all the time except 6 months. I have pay slips with me and W2 forms. Now I am working on the project but it will be over on 15th of April-09.
I will complete my 3 years. But after this project is over, I don't know I can find the job again.
My question is,is it right time to do the visa transfer? Does it requires very recent pay stub of 3 months? I do not have pay stub for Jan and Feb-09.Does it matters?
What will be my best choice to transfer the visa(but don't know will have job after 15th so does it matters for transfer like client letter) or wait until May-June and file the 3 year extension ? But again that time I will have pay slips until April only.
I am really confused. Please give me your suggestions

In Nov 2006 company XYZ filed my GC.
H1B got transferred to a couple of companies because I changed jobs while GC was being processed in parallel without being affected by my job changes because it was filed by another company.
In Oct 2007 got my EAD for a period of 1 year. Kept working on H1B only though.
EAD expired in Oct 2008. Applied for a new card but never received it. Did not apply for one after that.
In Nov 2009, I quit my job and moved back to home country giving up my H1B while still not affecting my GC because company XYZ agreed to keep it under process.
So at this time, I have no H1B and no EAD card. My priority date is however going to be current soon.
Now...
1) Do I have to be in the country before my dates get current or can I do that later?
2) On what status do I enter?
3) Can I delay the process somehow without affecting my GC?

Hello folks. I hope someone can help me out on this issue. I applied for my wife's EAD back in July 2007. The EAD was processed in two weeks and we received the card. However, my wife's middle initial was incorrect and we sent it back to USCIS with an explaination concerning the mistake. USCIS stated that it would take anywhere from 2 months to 6 months to process the correction. Last week I received a letter from USICS stating that I need to submit a completed I-90 form. A I-90 form is used to replace a green card. We just applied for our adjustment of status in 6/2007 and are not permanent residents at this point. Getting the EAD has become a nightmare for us. Do I try and write a letter back to USCIS stating that they are asking for the wrong form. I tried to call them but they said to respond to the letter sent. I'm stuck between a rock and a hard place. Any help/advice would be appreciated.

Sen. Dick Durbin (D-Ill.) is trying again to get the DREAM Act passed, re-introducing the measure on Wednesday to let some immigrant students in the U.S. illegally stay in the country. Durbin, Senate Majority Leader Harry Reid (D-NV), and Sen. Robert Menendez (D-NJ) and others will be on the bill.
Last December, after passing the House (then under Democratic control) the measure fell five votes short in the Senate and Durbin vowed to keep trying. The Durbin press conference comes a day after President Obama boosted the DREAM Act in an immigration speech in Texas, along the U.S./Mexico border where he called for various reforms.
When Durbin starts an issue, he stays with it. On Sept. 10, 2001, Durbin launched his fight to allow students of illegal immigrants to stay in the U.S. at a press conference in Chicago's Pilsen neighborhood. The DREAM Act became part of a larger national debate on the hot button, divisive immigration issue.
