Actually the change of status was meant to ask if the L1A gets rejected - can he move to L2 or H1 with change of status without leaving the country.

My wife is working as a consultant, her client is ready to give her full time and also ready to do her H1-B transfer. Her H1-B is valid till April 2011 and GC process has not been started yet. Client is hesitant to start GC because they are new to the process.
Questions
-----------
1. Can she take the offer from client company, get H1-B transferred and start GC process with another company X?
2. If that happens can she apply for H1-B extension with client company early next year?
3. Should her PERM application be submitted before April 2010?

I am planning to get religiously married by end of next year, 2009. But I am considering doing a quick court marriage in the next week since my dates are current. I have a couple questions regarding time frame:
1. If I do get my GC soon, then I need to apply for following-to-join. Is there a time limit for this? Can I do it as late as I want, as long as the spouse doesnt come to US before?
2. If I do not get GC for a while, is there a time frame after marriage before which I have to apply for my spouse's 485 as a dependent? Does she also need to be on H4 and in US before applying for 485?
Thanks a lot for all the help. I am relatively clueless about this marriage related GC business.

My H1 is expired and i am working in EAD now. I am going for vacation next week. I dont have valid I94 (as my H1 is expired, my I94 also expired), does it cause any problem when i reentry?
Does immigration give new I94 when we enter with AP? I appreciate your help.

Comp A (A Consulting Firm)applied for H1-B in April 2009 thru consular Processing and got approved. I worked for Client X in the month of April but lost my job in a week itself.(thus I dont have any pay Stubs from Comp A)Since Comp A was not able to find me a job. I found A full time job in Comp B in June 2009 , I somehow convinced Comp B to hire me as a contractor as I already have my H1-B approved thru Comp A. Thus from july 2010 I started working for Comp A again as my employer and Comp B as its Client. I am planning to go for VISA stamping in Dec 2010. My Question is
1) If they Ask for my Tax Returns and W2 for 2009 what should I answer as I just have my W2 frm Comp B
2) would there be a question of something like why havent I've been working for Comp A Since my H1 approval.
Please advice. I appreciate any kind of answer

Hello,
I am in the process of gathering my documents for EB1 filling. My lawyer and I went through my publication list today.
I have a number of peer reviewed publications that have been accepted and available online (with DOI - Digital Identification Identifiers) but have not yet made it to paper copies.
My lawyer is hesitant to include these "Online First" articles since they are not technically out He claimed that immigration tends to lean towards traditional publication channels and therefore it would be preferable to since technically, they are still in press.
Is this accurate? Under what conditions can one include accepted (online first) publications?

22 Democratic Senators are urging President Obama to stop deporting young people who are likely to be eligible for legalization if the DREAM Act passes. The White House has so far rebuffed such requests with the not very believable excuse that it's hands are tied. That's simply not so and the President's executive authority to solve immigration problems Congress is ignoring has been well documented. Hopefully, the pressure will start to pay off.

Hello,
I have a RFE for my 485 according to the online status. My PD is current, and NSC's 485 processing time is now July 19, 07. My 485 RD was July 25, 07, so it is likely that they are working on adjudicating my case (and could have approved if there were no RFE).
I am still waiting for the RFE in the mail to know what it is exactly. But, assume that I fulfill their request and mail them the required items immediately, will I need to wait another 6 months before they check my RFE fulfillment? Or do they usually look at the RFE immediately (since they are already working on my case)...

On November 27, the USCIS announced that they had received 58,900 H-1B petitions toward the 65,000 cap. So there are 6,100 numbers remaining, correct? (Update: By December 4, the USCIS had received 61,100 H-1B petitions toward the 65,000 cap.) Not exactly.
