I have filed two different I-140s for EB2-NIW (NSC, Nov 06)) and EB1-EA (TSC, march07). Both are pending at the moment. I wish to apply for I-485 now as the visa numbers are current in both categories.
I will appreciate if some one could advise if I can go ahead with the filing with pending I-140s. Also in that case can I file a single I-485 now and just ask it to be linked to whichever I-140 is approved first. will this work?
In this case whcih 140 number should I mention in my application and whcih center should I send the application to?

Is it possible to obtain a Greencard from L1B status? If yes, how long does this process typically take? My understanding is it is possible and definitely easier/shorter than being on H1?
Yes, it is possible to obtain a Green card from L1B. However, you will have to undergo the Labor certification process (PERM application). Time wise there will not be a difference whether you apply under H1-B or L1B. It is only foreign nationals who are managers and executives on L1A status are eligible to apply for the green card without the labor certification.

I am not sure if its a new rule to get an NOC from the husband, but as far as i know NOC is required only for Govt Employees. Make sure you really need one for getting a passport for an individual. If your wife is a Govt Employee then she may need one from the Govt/Office where she works.

For the past few months, there have been no green cards available for persons in the employment-based third preference category (EB-3) and long backlogs in the EB-2 category for persons born in India and China. So, with few green cards to grant, why has the USCIS been scheduling interviews for persons in these categories? Bottomline - if you are considering converting your LC case from TR to RIR, then your employer must send an email to DOL by Jan 20th and complete recrutiment process by April 1 ( or else case will be closed without recourse to appeal).

1) Shall I disclose the arrest to the attorney ? I am concern that it may backfire as I said "NO" for arrest in the background check forms etc.
You Should say "YES" and produce all the court records.
2) Can I travel & enter US without any issues ? Do I need to carry the expungement letter with me all times entering US?
I would advise not to travel unless you get an attorney to review all your documents and get a confirmation that you are not subjected to any bar under Sec 212 of the INA.
3) Does my arrest go to FBI ? Will I be asked for interview when my PD becomes current ?

Once you start working as a trainer, you have violated H-1B status so that you must rely on the EAD for both the gym job and the Systems Analyst position. You must also use Advance Parole, not the H-1B visa, to return after travel.

I had an H1 for about 3 years (2 different employers), and then was hired by an international organization. I gave up the H1 and got a G4 visa, which I still have. Over the last 3 years with a G4, my credentials have changed, and am due to get my masters degree in May 2008. If I were to move to a job requiring H1 when I get my masters, will the total number of years allowed for me to hold an H1 roll back to 6 years? I'm thinking that since the skills I had as an H1B visa holder before have changed now.

Hi! My drivers license has expired which was issued in Indianapolis, and I renewed the drivers license at Indianapolis which I could not get transferred to Florida ( no mail forwarding). Now question is, I want to renew new drivers license from Florida, will there be any problem if I use my old H-1B which was issued at Indianapolis, although I have shifted to Florida in a new job where my old H-1B transfer is till under process? what will the implications of using the old H1B?( I am still getting paid from my old employe)r

In theory, you can be the beneficiary of 2 H-1B petitions pending at the same time. This happens fairly often. Both could be approved and then you would be eligible to work for either company as long as that approval had not later been withdrawn.

Since you were working all these times, please carry the W2 for 2008 ( for both of you). They may/may not ask for this, but its safe to carry the document

I am planning to go to India due to some family reason and planning to get COS from H1 to H4 in India.
I have my salary slips and my husband has also maintained his status throughout.
Has anyone heard any horror stories about H4 stamping cases getting denied.
What documents they ask for when you go for COS from H1 to H4. Besides salary slips can they ask for my W-2's or they need my husband's W-2's only

I think you should be ok as long as the I-140 isn't revoked. Green card is for future job and so you dont need to be currently working for them.

I am working for a consultancy company at direct client location. My client has filed a H1B transfer petition for me with job title as Lead Business Analyst. My current job title with consulting company is programmer analyst. My question is that if I go for visa stamping with new employer�s I797, will I have any issues in visa stamping if they see the change in job title from programmer analyst (consulting company) to Lead Business Analyst (Full time)?

I Lost my I797A (but having photo copy) . I want to go to my Home country on emergency for 2 weeks and return to US.
Will I get visa stamping with
1. Copy of I797A and Employee's related documents ?
2. Copy of I797A and Employee's related documents + Proof of Duplication Request ?
3. Whether Duplication form (I-824) Should be separately filed for L1 & L2 ?
Please guide me Immediately.
